Introduction to Terms & Conditions

This document outlines the terms and conditions (referred to as “Terms & Conditions”) that govern your interaction with DOTDAT® and forms a binding agreement.

Definitions

“DOTDAT” refers to DOTDAT®, including all existing and future subsidiaries and affiliates. “Services” include this website and all related content, applications, features, functionality, information, and services provided. The terms “user,” “you,” and “your” refer to anyone who utilizes the Services in accordance with these Terms & Conditions.

Binding Agreement

By accessing, using, or otherwise agreeing to these Terms & Conditions, whether as an individual or entity, you enter into a legally binding contract with DOTDAT®. It is essential that you read these Terms & Conditions carefully before engaging with the Services. Any breach or non-acceptance of these Terms & Conditions may result in restricted access to the Services.

Amendments to Terms & Conditions

DOTDAT® reserves the right to modify these Terms & Conditions and/or the Services at any time. Notice of such modifications will be provided via updates on this website or through the Services. The date of the latest update will be indicated next to “Last Updated.” Continued use of the Services post-modification signifies acceptance of the revised Terms & Conditions.

Mandatory Arbitration Clause

Terms & conditions include a mandatory arbitration clause, necessitating individual arbitration for dispute resolution. This clause precludes jury trials, court proceedings, or class actions of any kind. (see Section 15 for details).

1. Licensing

DOTDAT® grants a conditional, non-exclusive, revocable license for website access and use per these Terms & Conditions. This includes a limited license to use the Services to prepare and submit Federal Regulatory Reporting (Report) and Beneficial Ownership Information Reporting (BOIR), as required by USDOT, FMCSA under 49 CFR, and FinCen under the Corporate Transparency Act.

2. Report Submission

While DOTDAT® assists in report preparation and submission, acceptance by USDOT/FMCSA/FinCen or compliance with 49 CFR/ the Corporate Transparency Act is not guaranteed.

DOTDAT®  does not offer legal or professional advice.

Accuracy of the provided information is your responsibility, and DOTDAT® does not independently verify this information. You affirm compliance with all relevant laws, including data privacy laws, and necessary authorizations in sharing personal information through the Services.

Submission of a Report implies your authorization to act on behalf of the Subject of the Report.

3. Privacy Considerations

Your privacy is of utmost importance. Review our Privacy Policy for details on information collection and usage in the Services. By using our Services, you consent to our practices as described in the Privacy Policy, which is an integral part of these Terms & Conditions.

4. Orders and Payments

Service features may be paid and requested through “Order” forms. Orders are subject to change. Acceptance constitutes a payment agreement.

5. Proprietary Rights

All content on the Services, including trademarks, text, designs, graphics, logos, and other materials, is the property of DOTDAT®, its content providers, or licensors. Your access does not grant any rights to use any proprietary content. All rights are reserved by DOTDAT® and its licensors. Unauthorized use of the material on the Services, including modification, distribution, or creation of derivative works, is strictly prohibited.

6. User Communications and Content

User-provided content grants DOTDAT® a non-exclusive license to use. Communications unrelated to report submissions may be used freely by DOTDAT®.

7. Reporting Unauthorized Content

For content posted without permission, contact us for removal per the Digital Millennium Copyright Act of 1998.

8.Acceptable Use

You agree not to misuse the Services, which includes restrictions on sharing accounts, using the Services unlawfully, posting inappropriate content, engaging in fraudulent activities, and refraining from using any device or software that interferes with the Services.

9. Communication Preferences

You consent to receive communications from us, with preferences manageable via contact.

10. Refund Policy

All sales through our Services are final. Refunds are issued only for billing errors or undelivered Services.

11. Limitation of Liability

DOTDAT®’s liability is limited as outlined herein, with no warranties beyond those permitted by law.

12.No Warranty

The Services are provided “as is” without any warranties. DOTDAT® disclaims all warranties, either express or implied, to the fullest extent permissible under the law.

13. Indemnification

You agree to indemnify and hold harmless DOTDAT® against all losses, liabilities, and costs arising from your use of the Services, your content, or your violation of these Terms & Conditions or any laws.

14. Service Outages

DOTDAT® is not liable for any loss or damage resulting from service outages, either planned or unplanned.

15. Dispute Resolution

-Governing Law: The Terms & Conditions are governed by the laws of the State of Idaho.

-Mandatory Arbitration: Disputes must be resolved through binding arbitration in Idaho, with no jury trials or class actions permitted.

16. Miscellaneous

These Terms & Conditions, along with our Privacy Policy, constitute the entire agreement between you and DOTDAT®. If any provision is deemed invalid, the remaining provisions stay in effect. All claims related to the Services must be filed within one year.
